CrossFit Cypher Membership Agreement
As a Member of CrossFit Cypher, I, the undersigned, hereby agree to uphold and be bound by the following rules and policies:
Monthly Membership Dues Policy
Monthly CrossFit Group, Personal Training, and Nutrition Membership dues are paid automatically on the 1st day of each month.
New Monthly Memberships are prorated for the 1st month. Regular monthly dues apply thereafter with payments made the 1st day of each month.
For Ongoing Nutrition Coaching, your initial bill will be backdated to the 1st of the month that your first in-person appointment falls.
Payment Methods Policy
Membership dues are paid by automatic electronic payment. We currently accept: ACH/EFT (Bank Transfer), Visa, Mastercard, and Discover.
We do not accept checks. Cash payments are allowed on a case-by-case basis, but cash payments must be made in advance of the bill due date. If a bill is due on the 1st of the month, a cash payment must be received before the 1st of the month. A valid Credit Card or EFT account must be kept on file as a backup, and if a cash payment is not made before the due date, the other account(s) will be automatically charged.
Membership Hold Policy
We do not allow membership holds for any/all memberships.
If you have a planned absence in an upcoming month, you may downgrade in advance (via our Change Request Form) to a lower per month attendance membership (12X/month or 16X/month). All our fixed classes/month memberships can be used at any time during a month. For example, if you have a two week vacation planned during the last two weeks of the month, you could simply use up all 12 or 16 of your classes during the first two weeks of the month.
Monthly Membership Change Requests Policy
Would you like to Upgrade or Downgrade your upcoming monthly renewal? No problem!
Submission of our Change Request Form (http://crossfitcypher.com/changes) will serve as your written notice, as is required. You must submit this form by no later than 8PM PST on the 20th day of the month prior to the upcoming month you would like the membership change to be effective for. Otherwise we will plan your change request for the subsequent month. There are absolutely no refunds for Month-to-Month Memberships.
You may also come in person to fill out a Change Request Form with the help of a staff member, still due by the 20th of the month prior.
Monthly Membership Cancellation Requests Policy
Submission of our Cancellation Request Form (http://crossfitcypher.com/cancellations) will serve as your written cancellation notice, as is required. Your membership will be cancelled for the following month and indefinitely thereafter unless other arrangements are made.
You must submit this form by no later than 8PM PST on the 20th day of the month prior to the upcoming month you would like the cancellation to be effective for. Otherwise we will plan your cancellation for the subsequent month. Upon rejoining CrossFit Cypher after the termination of membership, memberships will be updated to the current rate for new members (no maintenance of “grandfathered” rates for lapsed memberships). There are absolutely no refunds for Month-to-Month Memberships.
You may also come in person to fill out a Cancellation Request Form with the help of a staff member, still due by the 20th of the month prior.
Missed & Declined Payments Policy
If a payment is missed or declined, CrossFit Cypher reserves the right to re-submit the payment via any and all accounts we have on file until the payment is successful and all past due bills are paid. Cards should be kept up to date on your member profile (https://crossfitcypher.sites.zenplanner.com/login.cfm). If we are unable to successfully re-run the payment, CrossFit Cypher will attempt to contact the client using any means available to resolve issues. A $25 per day late fee will be charged if a bill is past due 5 or more days. These fees will be added to your bill for up to 7 days, and will remain on your account indefinitely until all past due bills + fees are paid. If we are unable to resolve the past due payment and/or we do not receive a response, CrossFit Cypher reserves the right to terminate the membership and prohibit any attempts to renew at a future date until all past due bills + fees are paid.
Early Termination of 90-Day Agreements Policy
If you are on a 90-Day agreement, you are expected to complete all payments on or before each bill’s due date, per the terms of your agreement. If you miss a payment by the due date, the same late fee rules and process described above apply to 90-day agreements. If for some reason you are unable to continue as a member at CrossFit Cypher, you must pay a $199 Cancellation Fee in order to be absolved of any remaining bills. If we are unable to resolve any past due payments and/or we are unable to contact you, CrossFit Cypher reserves the right to terminate the membership and prohibit any attempts to renew at a future date until this Cancellation Fee is paid.
Payments Made In Error/Duplicate Transactions Policy
If you believe you were incorrectly charged for a membership per the terms of your agreement, you have 72 hours (3 days) to contact us to request an adjustment or refund. It may take several days to process this, so we appreciate your patience.
No Refunds Policy
All sales are final, and we do not offer refunds under any conditions. If you are unhappy with your current membership, please come talk to us and we will try to find a solution together.
Personal Training Rescheduling & Cancellation Policy
For Personal Training Sessions, we require a minimum of 24 hours notice (e-mail, text message, or phone call/voicemail to your coach) to cancel and/or reschedule. If a dispute arises, you may be asked to provide documentation that you gave the required notice. Missed sessions or late cancellations will count as a session for the membership you have purchased with us. Make-ups will be billed as an additional drop-in sessions at a drop-in rate, or count towards your remaining total sessions for the membership.
No Transfers & Expirations Policy
We do not offer transfers of memberships from one person to another, or from one type to another. All monthly memberships expire at the end of the calendar month. All non-monthly memberships have explicit expiration dates, after which any remaining sessions are no longer usable.
There are no extensions, holds, or rollovers for unused sessions.

Unused Memberships & No Rollovers Policy
We do not offer rollovers for unused memberships. All monthly memberships automatically renew on the 1st of each month, and will continue to do so indefinitely unless a Change or Cancellation Request Form is completed. That being said, we will attempt to contact members who are not attending to resolve any issues.
Drop-ins @ CrossFit Cypher Policy
We welcome drop-ins for current, experienced CrossFitters visiting us from out of town. Please refer them to our Visiting CrossFitters page: http://crossfitcypher.com/visiting-crossfitters
We do not offer drop-ins or free trial classes for first-time CrossFitters, or for “used-to-CrossFitters.” CrossFit is still a very unique and potent way to train your mind and body, and as such requires a gradual build up that can only be facilitated by qualified coaches in the appropriate setting. Please refer your interested friends & family members to our “No-Sweat Intro” (http://crossfitcypher.com/intro) if they are interested in getting started with us. This way we can get to know them first and help them start their fitness journey the best way possible. We do not offer drop-ins for Open Gym only.
How Attendance Works
All monthly memberships are on an “attendances per month” basis. Although we often refer to a membership as “3X/Week” or “4X/Week”, those are actually considered “12X/Month” and “16X/Month,” respectively.
If you show up for a CrossFit Group Class or Open Gym on a given day, that counts for one of your monthly attendances. If you show up for Group Class but stay afterward for Open Gym, that still only counts for only one of your monthly attendances. However, if you come in the morning for Group Class and/or Open Gym, and then also come in the midday or evening for another Group Class and/or Open Gym session, that will count for two of your monthly attendances. Basically, we encourage you to stay late and do extra work, as this does not cause bottlenecks for classes and resources. But coming multiple times per day does, so we must value it appropriately.
Unless otherwise noted, special workout-related events such as Holiday workouts, Community Days, and The CrossFit Open will count as a normal attendance for current members.
Attendance Overages Policy
If you are on a fixed attendance per month (12X, 16X) and you go over your allotted amount, this is considered an “overage.” We appreciate your dedication and consistency, but when you pay for a specific membership we must uphold the value of it, and of our time, resources, and fairness to other members. Because overages often happen near the end of the month, the Coach or Staff member who checked you in will bill a $25 drop-in to your account for this extra attendance. They are also instructed to refer this occurrence to their manager, who will reach out to you as soon as we recognize this overage occurred, to help you choose the best option going forward for you:
1) For the remainder of the month you can come to the gym at our current Drop-In Rate of $25 for each class over your current allotment, including the overage that triggered this alert.
2) As a courtesy, we offer a retroactive upgrade of your current month’s membership to the next level up (Example: 12X/month to 16X/month, or 16X/month to Unlimited). We will also apply the auto-charge for your initial overage towards this upgrade. Reply to the e-mail you receive if you prefer this option. By opting in for this, you agree to keep the upgraded membership for at least the next full month, which will give you access to more classes on an ongoing basis. If you would like to change your membership after the following month, you must complete a Change Request Form per the normal process (20th of the month deadline): crossfitcypher.com/changes
Rejoining CrossFit Cypher Policy
If you decide to take a break from your membership with us per our normal Cancellation Request or Change Request Forms, you may rejoin anytime within 60 days by contacting us and signing up for a new membership. If more than 60 days has passed, you will be required to complete a Fundamentals series (or On-Ramp class if we are currently offering one) in order to ensure your safety and the efficacy of our programs.
Help I’ve Fallen Off the Wagon
If your life circumstances have changed and you are having a hard time making it to our gym, please reach out to us by booking a Goal Review Session. This is an important intervention to help get you back on track, and could save you from having to cancel and then re-start your fitness journey again some indeterminate time in the future. We are here to help.
Referring Friends or Family Members to Join
Please refer your interested friends & family members to our “No-Sweat Intro” (http://crossfitcypher.com/intro). We want to get to know new members before their first workout with us. What are your goals? What motivates you? Why? What has worked in the past, and why did you stop? These are all important questions to discuss so we can choose the best path forward.
We have a designated, gated Kids Area at the gym where your well-behaved child(ren) can sit quietly on the couch while you get your workout in. The gate must remain closed and locked while they are in the Kids Area. The Kids Area is the only area in the gym kids (under 18 years old) are allowed without a parent or guardian standing by their side. For theirs and all our members’ safety, kids are not allowed on the gym floor at any time during daily operations and training/class times, unsupervised in the office area, or any other area of the gym. It is your responsibility to make sure you child remains in the Kids Area, that are not a danger to themselves or others, that they are not causing disruptions or distractions to regular gym activities, and to clean up after your child and return the Kids Area to its original, clean state. If your child escapes from the Kids Area, it is your responsibility to stop what you are doing and escort them back to the Kids Area. If this happens repeatedly, you may be asked to take them home for the day and meet with the management to discuss whether they are able to return to our gym. Except in the event of a medical or safety emergency, only a parent or legal guardian may escort your child into or out of the Kids Area. Other members or parties who are not legally responsible for your child may not supervise or escort your child while on our premises.
For those with kids interested in becoming a member: we are happy to introduce your kids to our fitness programs and our community by appointment. Please come talk to us or schedule a No-Sweat Intro to have them visit! On a case by case basis, we sometimes allow teenagers 15-18 years old to graduate to adult group classes if they are mature enough for that environment. You are welcome to bring your kids to community events such as potlucks, group outings, as spectators at competitions and/or events, and of course to designated Cypher Kids classes.
We are fortunate to have good parking availability! However, not all spaces are available for our members’ use. Please park in either spots designated for our Suite # (290), or ones that are blank/unmarked. Otherwise street parking available. Please do not park in neighboring spaces or lots for other businesses, as you will likely get ticketed. Please do not leave valuables in your car, or leave your vehicle overnight. CrossFit Cypher is not responsible for break-ins, vandalism, or theft.
Members shall pay for any damages to CrossFit Cypher property which results from the willful or negligent conduct of member, member’s guests, or children.
Lost/Stolen Item Policy
CrossFit Cypher cannot be held responsible for the loss or theft of personal items left in the gym, in the bathroom or building, or in a car parked on our premises. Our Lost and Found is currently designated in one of labeled cubby spaces. Items left out on the gym floor due to forgetfulness (doh!) will be placed here to the limit of the cubby’s capacity, or moved to the office. Our cleaning service has also been instructed to throw away water bottles and miscellaneous clothing that do not fit in the Lost and Found. Cypher Staff will review these items at the beginning of each week, and if they are not claimed will either be donated or thrown away.
The Golden Rule Policy
The Golden Rule is the principle of treating others as one would wish to be treated. It is a maxim of altruism seen in many human religions and human cultures. The maxim may appear as either a positive or negative injunction governing conduct:
One should treat others as one would like others to treat oneself (positive or directive form).
One should not treat others in ways that one would not like to be treated (negative or prohibitive form).
What you wish upon others, you wish upon yourself (empathic or responsive form).
The Golden Rule differs from the maxim of reciprocity captured in do ut des—”I give so that you will give in return”—and is rather a unilateral moral commitment to the well-being of the other without the expectation of anything in return.
CrossFit Cypher strives to provide a positive and encouraging environment and culture for our clients, staff members, and their families. Anyone that is disruptive or negatively influences this environment, or attempts to undermine, subvert, troll, or take advantage of our policies, staff, other members, or general good will is subject to having their membership permanently revoked. This is at the sole discretion of CrossFit Cypher Management.
Members who do not observe CrossFit Cypher rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership to anyone who refuses to observe any of CrossFit Cypher’s rules or regulations. Not all rules and regulations are listed in this agreement. CrossFit Cypher reserves the rights to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by CrossFit Cypher.
This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties. Member has read, and fully agrees to the term of this Agreement and understands and agrees that by signing this
Agreement Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement. If any portion of this agreement is deemed illegal, void or unenforceable, then the remaining agreement shall remain in effect.
